Supreme Court Rules Against Reinstating Immigration Detention Policy

The Supreme Court has refused to reinstate an immigration detention policy by the Biden Administration that would direct Immigration and Customs Enforcement (ICE) officers to prioritize immigrants who threaten national security or public safety. The ruling comes after a decision by a Texas district court judge, who ruled that the policy violated federal law. The Department of Justice (DOJ) requested the policy be allowed to remain in place while the decision was being appealed, but the Supreme Court rejected their request.

Afghanistan Citizens Now Eligible For TPS Protections

The Department of Homeland Security (DHS) has announced that it is offering Temporary Protected Status (TPS) for Afghanistan citizens currently living in the United States, as of May 20, 2022. This will allow Afghanis currently residing in the U.S. without other legal status to apply for special protection. This will allow them to legally remain in the United States, and also apply for work authorization.

DHS Announces TPS Registration for Citizens of Ukraine and Sudan

The Department of Homeland Security (DHS) has announced the registration process to allow citizens of Ukraine and Sudan currently in the United States to register for Temporary Protected Status (TPS). The registration for this process began on April 19, 2022, and applies to anyone from Ukraine that has lived continuously in the U.S. since at least April 11, 2022, as well as anyone from Sudan who has lived in the U.S. since March 1, 2022. People who want to benefit from TPS must file an application, and do not receive its protections automatically.

Proposed Asylum Rule Could Reduce Massive Case Backlog

To help address a years-long backlog on asylum claims, the Biden Administration has formally proposed a rule that would potentially transform the current asylum system. The new asylum rule, if adopted, would substantially speed up the process of applying for asylum, by allowing asylum officers to adjudicate asylum applications without needing to go before an immigration judge. This could take asylum applicants out of the system, allowing asylees to get the protections they need much faster.

US Prepares to Welcome 100,000 Refugees From Ukraine

President Biden has announced that the United States will be accepting up to 100,000 refugees from Ukraine to assist with the humanitarian crisis going on in the country. The Biden Administration has also said that it is examining various legal pathways that could be offered for Ukrainians to help them get legal status in the United States. The announcement comes as the Russian invasion of Ukraine enters its second month, and increasingly civilians are displaced by combat.

Ukrainian Citizens in US Granted Temporary Protected Status (TPS)

The Department of Homeland Security (DHS) has announced it will be granting Temporary Protected Status (TPS) to any Ukrainian citizens who were living inside the United States as of March 1, 2022. This will help to protect Ukrainians who may fear returning to their home country while it is embroiled in warfare against the Russian Federation.
